A company’s determination that you are at fault is not binding in the courtroom. If you are found at fault during a legal proceeding in Texas, then the rule of Comparative Fault will determine the outcome. Under the rule of Comparative Fault, each party who is found negligent is assigned a percentage of fault, and the injured person does not recover their percentage.
